The July 1st Access, Noventis, and Sunova Credit Union merger is now complete. In order to perform integration activities leading up to the formal merge date, member personal information has been shared between the three entities in strict accordance with section 7.2(1) of PIPEDA as it relates to business transactions.
In April 2000, The House of Commons enacted the Personal Information Protection and Electronic Documents Act which affects the way corporations collect, maintain and use personally identifiable information. Hubert Financial has adopted a Privacy Code that is designed to protect the confidentiality of your personal information. This code follows the principles of Canada’s privacy legislation as stated in the Personal Information Protection and Electronic Documents Act.
Protecting the personal information we collect and maintain is as important to us as it is to you. Like other organizations, we require a certain amount of personal information to conduct business and provide you with the products and services you are requesting. Hubert Financial will always treat your information in a confidential manner and is committed to keeping personal information confidential, secure and private. In adopting this Privacy Code for the Protection of Personal Information, what is the accepted practice of Hubert Financial becomes a documented commitment to our members.
Ten principles form the basis of our Privacy Code:
Accountability
We are responsible for all personal information under our control and have designated individuals who are accountable for our compliance with the ten principles that comprise our Privacy Code.
Identifying Purposes
When we ask for personal information from our members, we must identify what we will use it for.
Consent
We require your knowledge and consent for the collection, use, or disclosure of your personal information, except where it is required or permitted by law.
Limiting Collection
The information we collect is limited to only the purposes we have identified to you. We will only collect information by fair and lawful means.
Limited Use, Disclosure and Retention
We use and disclose your information only for the purpose we collected it for, unless you consent otherwise or as required by law. We retain personal information only as long as necessary to fulfill those purposes.
Accuracy
We maintain and update your information as necessary to ensure accuracy for the purposes for which it is used.
Safeguards
We protect your information with security safeguards appropriate to the sensitivity level of the information.
Openness
We make information available to you regarding the policies that apply to the management of your information.
Member Access
At your request, we will inform you of the existence, use, and disclosure of your personal information, and will give you access to that information. You may confirm the accuracy and completeness of your information and may request changes if necessary.
Compliance
A member shall be able to question compliance with the above principles. All inquiries regarding privacy should be in writing to the privacy officer.
Why we ask for your information
We hold personal information about members to help us meet and maintain the highest standards of financial service. The information we ask for will depend on which products or services you would like. For every product or service, we need your name, address, and some identification. We only collect and use the information for the purposes explained to you. Here is why we need some of the other information we ask you to provide:
Birth Date. This helps us identify you and may also be used to determine your eligibility for products and services that may be of benefit to a particular age group.
Social Insurance Number (SIN). Your SIN is required for products which earn investment income, in order to comply with Canada Revenue Agency’s income reporting requirements. We also use it to keep your information separate from that of other members with a similar name, including information we obtain with your consent through the credit approval process.
Financial Information. This is used to ensure that the advice we give you is appropriate for you.
When you apply for a new product or service, we will indicate in the application or agreement how we intend to use your information. If we need to use it for another purpose, we will ask you for your consent at that time.
When we use and share information
Hubert Financial does not sell member lists or personal information to others. However, we may release personal information to parties outside Hubert in limited circumstances.
These are some examples of when we may share information:
- Within Hubert to manage your relationship with us
- With others who share ownership or liability for a product or service you have with us, such as a joint account holder
- With your legal representatives
- In response to a valid subpoena, warrant, court order, or other legal demand or request. We will only disclose the information required or permitted by law.
- To comply with legal and regulatory requirements
- To help us collect a debt owed to us by you
- To an organization to prevent, detect or investigate fraud
- During an emergency that threatens the life, health or security of an individual
- To investigate an offence under the laws of Canada or another jurisdiction
- In order to complete a business transaction such as a merger with another credit union
- To a government institution or an individual’s next of kin or authorized representative when there is reason to believe a member has been, is or may be the victim of financial abuse
- When permitted or required by law
In the course of doing business, personal information may be shared with affiliates, external agents or service providers that perform services on our behalf. We choose reputable companies, provide only the minimum amount of information necessary and use contracts and other measures to provide a comparable level of protection and compliance while information is being sent to or processed by them.
These services could include but are not limited to data processing, secondary support, marketing and administrative services. Service providers are not allowed to use your personal information for any unauthorized purpose.
In some cases, service providers may be located outside of your province or Canada. Personal information may be subject to and accessed under the laws of the jurisdictions in which these service providers operate.
